NYS Patricia Smith - New U.S. Solicitor of Labor

CHEERS! Today the U.S. Senate confirmed New York State’s Commissioner of Labor M. Patricia Smith as U.S. Solicitor of Labor. After nine months of delays, the final vote was 60 to 37. As one of the top 3 officials in the department, she will have substantial impact on the future of American workers. Here in New York Smith was a strong advocate for women and minorities. A good sign for better days ahead for workers’ rights.

NYWA and the Equal Pay Coalition NYC were strong and active supporters of her confirmation based on her excellent track record and credentials….Congratulation, Solicitor Smith!

Federal Training - Reinforcing Wage Gap

A new study by IWPR shows that federally funded training may reinforce sex segregation and the gender wage gap. Women on average earn $1500 to $2000 less per quarter than men after federally funded career counseling or training. After completing services, women earn 79.5 percent of what men earn among adult participants and 74.1 percent of what men can earn among dislocated workers.
The wage gap is not due to less training: on average women received more weeks of WIA-funded training than men. WIA-funded services primarily train women for female-dominated, typically lower paying occupations and men for male-dominated, typically higher paying occupations.

2008 CENSUS DATA: WOMEN’S INCOMES DECLINE and POVERTY INCREASES

Just reported: Women working full time, year round in 2008 earned 77% of what comparable men earned – a statistically significant decrease from the 2007 figure of 78%. When compared to the earnings of White, non-Hispanic men ($51,244), the median earnings of White, non-Hispanic women working full-time, year round were $37,389 in 2008 (73%); Black women: earned $31,489 (61.4%); and Hispanic women earned $26,846 (52.4% ).
Poverty – and extreme poverty – increased significantly between 2007 and 2008 for women, children and men. The number of women living in poverty rose to 15.2 million in 2008 from 14.4 million in 2007. The number of children living in poverty rose to 14.1 million from 13.3 million and the number of men living in poverty rose to 10.6 million from 9.5 million. The child poverty rate rose to 19% in 2008 from 18% in 2007. The poverty rate for married-couple families with children rose significantly, to 7.5% in 2008 from 6.7% in 2007. The poverty rate for female-headed families with children was much higher than that for married couples, at 37.2% in 2008, but was statistically unchanged since 2007. Full Census report

VICTORY FOR EQUAL PAY….BASED ON LEDBETTER

LAWS MATTER!
VICTORY FOR EQUAL PAY IN THE COURTS BASED ON LEDBETTER!
(Washington, D.C.) In a triumphant development for equal pay, the Third Circuit Court of Appeals today ruled in favor of Mary Lou Mikula, holding that her Title VII pay discrimination claim had been erroneously dismissed on the basis that her charge was not timely. The decision relyed on the newly enacted Lilly Ledbetter Fair Pay Act.

The Ledbetter Fair Pay Act restored the law that existed for decades in virtually every region of the country prior to the Supreme Court decision in Ledbetter v. Goodyear Tire and Rubber Co. and makes it clear that each discriminatory paycheck is a new act of discrimination that resets the 300-day time period to file a claim.

This ruling underscores the need for strong equal pay laws. We urge you to push Congress to pass the Paycheck Fairness Act that will build on the Ledbetter bill by protecting employees and providing incentives for employers to comply with the law. The bill has passed the House and is still gathering co-sponors in the Senate. It currently has 33…and we need more.

BACKGROUND: The Lilly Ledbetter Fair Pay Act was the very first bill signed into law by President Obama. Does this mean that we can stop working for passage of the NYS Fair Pay Act?  NO!  The Ledbetter Act restores protections for people whose jobs involve the same work.  NY State Fair Pay Act (A3911, S955) is aimed at job- title pay equity that removes discrimination in the pay of job titles in fields such as library, food service, clerical and office management where women and people of color are the majority of the workforce.  Job titles traditionally done by women and people of color have been undervalued in the marketplace.  Unfortunately, the Ledbetter Act does not address pay inequities across different but equally-valued job titles.  MORE on Background page

The NYS Fair Pay Act (S.955) is now in the Finance Committee, chaired by Brooklyn Senator Carl Kruger. With just a short time remaining in the session, it is NOT on the agenda despite having 25 CO-SPONSORS (including Sen. Carl Kruger) and being passed in the Assembly annually since 2002! With the change of leadership this year, the voters expect that this bill would no longer be held hostage in a Senate committee, but reach the floor for a vote.  Ask our Senators to show the leadership they promised by advancing the NYS Fair Pay Act! NYS SENATORS MUST HEAR FROM US IMMEDIATELY IF WE WANT ACTION THIS YEAR!
